Listing removal

Overview

This page covers two related procedures on DMC.travel:

  • Part A — Listing Removal & Information Update. For owners or authorized representatives of a company listed on DMC.travel who would like the listing corrected or removed.
  • Part B — Intellectual Property & DMCA Takedown. For rights holders (or their authorized agents) who believe content on the Platform infringes their copyright, trademark, or other intellectual property right.

Part A — Listing Removal & Information Update

A.1 Purpose

This Procedure explains how owners, managers, and authorized representatives of companies listed on DMC.travel can have their listing corrected or removed. It is the operational companion to the rights described in our Privacy Policy under GDPR Articles 16, 17 and 21, and it is also available to companies based outside the European Economic Area as a matter of good practice.

A.2 Who can submit a request

  • The owner or a director of the listed company.
  • An employee of the listed company who has authority to manage external communications (for example, a marketing manager, a sales manager, or a general manager).
  • A lawyer or other authorized representative acting on behalf of the company, with a brief description of the mandate.

A.3 How to submit a request

Use the form below, or send an email to privacy@dmc.travel with the subject “Listing Update / Removal”.

To allow us to action the request quickly, please include:

  1. The exact URL of the listing.
  2. Your full name, position, and the email or phone number under which the company can be reached.
  3. Whether you are asking for: (a) correction of specific information; (b) full removal of the listing; or (c) suspension while you discuss listing-management options with us.
  4. If correction: the exact text or detail you want changed and what it should be.
  5. Optional: any document that helps us verify your authority to act for the company (a business email signature is normally enough; we may ask for more if the request comes from a non-business email address).

A.4 How long it takes

  • We acknowledge receipt within five (5) business days.
  • Most corrections are completed within seven (7) calendar days.
  • Full removals are completed within thirty (30) calendar days. We may complete them faster where the request is straightforward.

A.5 Cost

There is no charge for correction or removal.

A.6 Possible outcomes

  • Correction. We update the listing and confirm by email.
  • Removal. We remove the listing from the public website. We may keep the underlying record in a deletion log for a limited period to honor the request and to prevent the listing from being reintroduced through automated re-imports.
  • Suspension. We hide the listing from the public website while we discuss options with you (for example, if you would like to claim and manage the listing yourself).
  • Refusal. In rare cases (for example, manifestly unfounded or excessive requests, or where we have a legal obligation to keep certain information available), we may refuse a request. We will explain the reason in writing and inform you of your right to lodge a complaint with the Cypriot data-protection authority or the equivalent authority in your country.

A.7 What happens after removal

Once a listing is removed, the public URL returns a “Not found” response and the listing is excluded from our automated import pipelines so that it is not republished from the same source. Search engines may still cache the page for a limited period; we have no direct control over third-party caches but we will, on request, also send a removal request to the major search engines.


Part B — Intellectual Property & DMCA Takedown

B.1 Overview

GMS LTD respects intellectual property rights. This Part describes how rights holders can notify us of allegedly infringing material on DMC.travel and how affected users and listed companies can respond to such notices. The procedure is designed to comply with the U.S. Digital Millennium Copyright Act (DMCA), the EU Digital Services Act (DSA) notice-and-action regime, and equivalent regimes in other jurisdictions where relevant.

B.2 Submitting a takedown notice

If you believe that material accessible on or through DMC.travel infringes your copyright, trademark, or other intellectual property right, you may submit a notice to our designated agent at takedown@dmc.travel. To be valid, the notice must include all of the following:

  1. Your full legal name, postal address, telephone number and email address.
  2. A clear identification of the work or right you claim has been infringed (for example, a URL where the original work is published, a registration number, or a description sufficient to identify the work).
  3. A clear identification of the material on DMC.travel that you claim is infringing, including the URL of each affected page.
  4. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the rights holder, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder.
  6. Your physical or electronic signature.

Notices that are missing any of these elements may be rejected without action. We strongly discourage frivolous or abusive notices; under U.S. law (17 U.S.C. § 512(f)) you may be liable for damages, including costs and attorney’s fees, if you knowingly materially misrepresent that material is infringing.

B.3 What we do with a valid notice

Upon receipt of a notice that on its face appears valid, we will (i) acknowledge receipt within five (5) business days, (ii) review the notice, and (iii) where appropriate, remove or disable access to the allegedly infringing material expeditiously and notify the affected user or listed company. We may, where reasonable, narrow the scope of the action to only the specific material identified.

B.4 Counter-notice

If you are the user or listed company whose material has been removed or disabled and you believe the takedown was wrong (for example, because of fair use, fair dealing, a license, mistaken identity, or because the notice itself is fraudulent), you may submit a counter-notice to takedown@dmc.travel. The counter-notice must include:

  1. Your full legal name, postal address, telephone number and email address.
  2. Identification of the material that was removed or disabled and the URL where it appeared.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the courts in your judicial district (for U.S. residents) or, in any case, the courts of Nicosia, Cyprus, and that you will accept service of process from the original notifier.
  5. Your physical or electronic signature.

Where the counter-notice is valid, we will forward a copy to the original notifier and may restore the material no earlier than ten (10) and no later than fourteen (14) business days after forwarding, unless the notifier confirms that they have filed a court action seeking to enjoin the alleged infringer.

B.5 Repeat infringers

We will, in appropriate circumstances, terminate the accounts and remove the listings of users and listed companies who repeatedly infringe the intellectual property rights of others.

B.6 Trademark and other IP claims

Notices alleging infringement of trademarks, design rights, or database rights follow the same general procedure described above, adapted to the specific intellectual-property right concerned. Please describe the right asserted and the basis on which you hold it.
